PERSONAL DATA NOTICE AND CONSENT OF USE PURSUANT TO PERSONAL DATA PROTECTION ACT 2010 (“PDPA 2010”)

We KIARAMAS DEVELOPMENT SDN BHD (“the Developer”) and/or its associates and/or related companies and/or companies within its group hereby endeavour and shall safeguard the usage of the personal data herein provided or disclosed by its Applicants, Purchasers and/or Customers in compliance with the Personal Data Protection Act 2010 (PDPA 2010). The Applicant, Purchaser or Customer herein shall be defined as either Individual Person(s) or Company/Companies.

PERSONAL DATA INFORMATION SHALL OR MAY INCLUDE:
1. For Individual Person(s)
  Name, identity card number, passport number, nationality, gender, date of birth, marital status, race and religious belief, correspondence and/or mailing address, telephone number, mobile number, facsimile number, email address, occupational information, income range, type of loan facility applied, bank account details and any other miscellaneous information.
2. For Company
  Name, business and/or company registration number, date of establishment or incorporation, correspondence and/or mailing address, telephone number, facsimile number, email address, nature of business, company directors and/or authorised shareholders information, type of loan facility applied, bank account details and any other miscellaneous information.
COLLECTION OF PERSONAL DATA:
Personal data shall and may be collected either from the Applicant, Purchaser or Customer or from his/her/their authorised representatives, from third parties whether relatable or non-relatable to the Applicant, Purchaser and/or Customer or from publicly available or accessible sources which include (but not limited to) the following methods:
1. Through direct registration via our Purchase Application Form(s), online websites, digital source and/or any other digital apps or social media including but not limited to WhatsApp, Facebook and/or various marketing campaign network for any existing or future projects and/or developments.
2. Direct contact in person, physical presence over the counter or visit to our office premise, telephone calls of whatsoever purpose such as general enquiries, feedbacks, comments, complaints, update of records, etc.
3. Via direct participation in any general surveys, questionnaires, promotional events, competitions, contests, offers conducted internally or via appointed third party.
4. Data and information provided either directly or indirectly from any third parties such as property or real estate agent(s), solicitors, financial institutions, licenced credit agencies, authorised sales and marketing agent(s), property valuers, building management, joint management bodies and/or management corporation.
5. Any such other sources where the Applicant, Purchaser or Customer have given his/her/their consent for the disclosure of his/her/their personal data and/or where otherwise lawfully permitted.
USAGE OF PERSONAL DATA:
1. To inform, notify and update the Applicant, Purchaser or Customer relating to any current and future project launch, upcoming events, promotions and other marketing activities via mail, email, telephone calls, text messages and/or social media.
2. To send, issue and deliver any form of notices, information updates, billings or invoices, official receipts, reminder notices and/or other necessary correspondences.
3. To conduct billings and/or to collect payments from the Applicant, Purchaser or Customer or to his/her/their end-financier whichever the case may be.
4. To facilitate the process of delivery of vacant possession, property management, customer care and/or defect rectification works and/or renovation works.
5. To facilitate correspondences, communications and response to general enquiries, complaints and resolve of disputes and/or general discrepancies.
6. For conducting internal or external auditing or to make disclosure under the legal or regulatory requirements of any applicable existing and/or newly enacted laws, regulations, by-laws, direction, court order, guidelines, circular, codes applicable.
DISCLOSURE OF PERSONAL DATA:
The Applicant, Purchaser or Customer’s personal data shall be needed and/or required to be disclosed to the following parties:
1. Employees including any authorised personnel of the Developer, its related companies and/or within the group of companies.
2. Solicitors and/or legal firms.
3. Financial Institutions and/or licenced credit agencies.
4. Internal and/or external Auditors.
5. Building Services Providers and/or Utility Board authorities but not limited to Tenaga Nasional Berhad, Pengurusan Air Selangor, Indah Water Konsortium and/or Telekom.
6. Property and/or real estate agents.
7. Federal or State Government authorities and/or government agencies not limited to land offices and/or town or district council.
8. Any parties in respect of whom you have given your express or implied consent.
SECURITY OF PERSONAL DATA:
The Developer will apply strict procedures to prevent unauthorised access wherever possible to your personal data and shall keep and process your data in a secure manner.
ACCESS AND UPDATE OF PERSONAL DATA:
1. For purpose of updating, correcting, deletion or amendments of personal data, the Applicant, Purchaser or Customer may at any time write in officially or to email to the Developer at property@asiaquest.com.my.
2. The Applicant, Purchaser or Customer is/are obligated to ensure that all Personal Data submitted are accurate, not misleading, complete and up to-date in all aspects.
3. The Developer, its related companies, companies within its group and/or its employees or its representatives shall not be responsible or liable for any Personal Data submitted by the Applicant, Purchaser or Customer which is/are inaccurate, misleading in nature, incomplete and/or not up to-date.
4. For avoidance of doubt, the Applicant, Purchaser or Customer’s Personal Data shall include all data defined within the Personal Data Protection Act 2010 including all data submitted and disclosed in this form.

By submitting your personal data through the manner as per item B (Collection of Personal Data) abovementioned, you hereby duly acknowledge, agree and consent unconditionally to the Developer to collect, record, store, use, disclose and process my/our personal data as stipulated and provided herein.
